1. Acceptance of Terms
By accessing or using the GWPG Store (gwpg-store.com), operated by Golden West Packaging Group ("GWPG," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the store. These terms constitute a legally binding agreement between you and Golden West Packaging Group.
2. Account Registration
Access to the GWPG Store is by invitation only. Accounts are created by a GWPG administrator on behalf of approved business customers. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. GWPG reserves the right to suspend or terminate accounts at any time for any reason.
3. Products & Pricing
The GWPG Store offers B2B packaging products, including clamshell packaging and wine shipping solutions. All prices are listed in U.S. dollars (USD) and are subject to change without prior notice. Many products have minimum order quantities that must be met to place an order. Volume-based tiered pricing may apply, with discounts available for larger quantities as displayed on individual product pages. While we strive to ensure accuracy, product descriptions, images, and pricing may contain errors, and we reserve the right to correct them at any time.
4. Orders & Payment
Order Acceptance
All orders placed through the GWPG Store are subject to acceptance at GWPG's sole discretion. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, pricing errors, or suspected fraudulent activity.
Payment Methods
Payment is accepted via credit card processed securely through Stripe, or via approved net payment terms for qualifying customers. Net terms must be arranged and approved by GWPG prior to use. Payment is due according to the terms agreed upon at the time of order.
Taxes
All listed prices exclude applicable sales tax unless you have provided a valid resale certificate or tax exemption documentation. Customers are responsible for any applicable taxes not collected at the time of purchase.
5. Shipping & Delivery
Orders are shipped via UPS, FedEx, or local delivery for destinations within 150 miles of our facility. Free shipping is available for orders totaling $750 or more (before tax). Shipping times provided at checkout and in order confirmations are estimates only and are not guaranteed.
Risk of loss and title for all products pass to the buyer upon transfer of the shipment to the carrier at our facility. GWPG is not responsible for delays, damage, or loss caused by the shipping carrier after pickup.
6. Returns & Refunds
Returns and refunds are handled in accordance with our Refund Policy. Please review our Refund Policy for full details on eligibility, timelines, and procedures for returning products or requesting a refund.
7. Tax Exemption
Customers claiming tax-exempt status are responsible for providing a valid resale certificate or other applicable tax exemption documentation to GWPG. Tax exemption will not be applied until valid documentation has been received and verified. GWPG reserves the right to charge applicable sales tax if exemption documentation is not provided or is deemed invalid.
8. Intellectual Property
All content on the GWPG Store, including but not limited to text, graphics, logos, images, product descriptions, and trademarks, is the property of Golden West Packaging Group or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this site without prior written consent from GWPG.
9. Limitation of Liability
To the fullest extent permitted by law, GWPG shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the store, purchase of products, or these Terms of Service. This includes, without limitation, loss of profits, data, business opportunities, or goodwill. In no event shall GWPG's total liability to you exceed the total amount paid by you for the specific order giving rise to the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless Golden West Packaging Group, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the store, violation of these Terms of Service, or infringement of any third-party rights.
11. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the state and federal courts located in San Joaquin County, California.
12. Changes to These Terms
GWPG reserves the right to update or modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the GWPG Store after any changes constitutes acceptance of the revised terms. We encourage you to review these terms periodically.
